Masterclass Terms of Engagement

Julia Ewert provides online Masterclasses to startups, small businesses and organisations.

Drawing on over two decades of business experience and working for some of the largest global brands, Julia is a skilled business consultant specialising in sales strategy and sales leadership.

This Terms of Engagement (“the Agreement”) is between Julia Ewert Pty Ltd ACN 644 810 444 (the “Consultant”) and YOU, (the “Client”) for consulting, training and Masterclass services.

While it is not expected that this Agreement will be signed and returned by you, you are deemed to have read and accepted the Terms and Conditions contained in this Agreement by receiving Julia’s products and/or services.

 

Terms and Conditions

Products and Services
Julia Ewert provides the following products and services:

  • Sales/Negotiation Workshops
  • Sales Process Implementation
  • Sales Leadership Programs
  • Sales Advisory Services (troubleshooting, targeting training and workshops)
  • Online video Masterclasses

Please refer to your Invoice or Order Confirmation for details of your selected service and pricing to which this Agreement applies. All sessions and services are non-transferrable.

Payment – Online Masterclasses
The Consultant reserves the right to change published fees at any time.
All fees are in AUD and exclude GST unless otherwise stated.

Service cancellation
All cancellations and requests for refunds must be in writing via email to julia@juliaewert.com.

Refund Policy
Requests for refunds are considered on a case-by-case basis and may be offered entirely at the Consultant’s discretion.

Refunds will not be considered or issued for a change of mind.

Your obligations
You understand and agree

  • You are not allowed to on-sell or share any Julia Ewert training materials.
  • You are fully responsible for your progress and results from your selected training package.
  • Individual results may vary because of the nature of the service and outcomes depend entirely upon your participation, personal skills and abilities and commitment.
  • Payments for services must be made according to this Agreement.
  • You agree that you will not record any online session on your phone or other devices without the express written permission of Julia Ewert.

Intellectual Property
Julia Ewert owns all Intellectual Property and related material (the “Intellectual Property”) including but not limited to presentations, templates, frameworks, questionnaires, coaching plans and training guides, that are developed or produced under this Agreement or through Julia Ewert carrying out the contracted services.

The Client is granted a non-exclusive, royalty-free, and limited-use license of this Intellectual Property for personal or business use and no other commercial purpose.

The title, copyright, intellectual property rights and distribution rights of the Intellectual Property remain exclusively with Julia Ewert.

Permitted use – client logo and testimonials
The Client grants Julia Ewert a non-exclusive and royalty-free license to use their logo and testimonial (in full or in part) to promote Julia Ewert’s services on the company website, social media and other marketing material.

Acknowledgment & Disclaimer
You understand and agree:

  • You have engaged Julia Ewert’s services at the agreed Fee.
  • Julia Ewert cannot guarantee any results for you, and as such, you are 100% responsible for your progress and outcomes.
  • Julia Ewert Consulting cannot control the level of your commitment nor your participation, and it is your responsibility entirely to support or implement a strategy or changes resulting from training and consulting with Julia Ewert.
  • You accept that given the nature of Julia Ewert’s services, results experienced by every Client will differ you accept responsibility for any such variance.
  • Julia Ewert is not a financial planner or accountant, nor does she provide business development or wealth creation strategy advice.  You are advised to consult with a qualified professional for any commercial or financial advice or support you may require.

Earnings disclaimer
Julia Ewert cannot and does not make any guarantees about your ability to get results or earn any money from advice, ideas, information or strategies provided.

You acknowledge that there is an inherent risk in any business enterprise or activity. There is no guarantee that you will earn any money as a result of your engagement with Julia Ewert’s services.

Nothing in the disclaimers above will limit or exclude any liability that may not be limited or excluded by applicable law.

Confidentiality
Every effort will be made to maintain security and confidentiality of all information shared;  however, Julia Ewert takes no responsibility for the security of information shared via third-party applications such as email providers or social media platforms which may be accessible to third-parties.

Limitation of liability

  • Liability for the services provided by Julia Ewert is governed solely by the Australian Consumer Law and these Terms and Conditions
  • Nothing in these Terms removes your Statutory Rights as a consumer under Australian Consumer Law.
    To the extent permitted by law, Julia Ewert excludes all express or implied representations, conditions, guarantees, warranties and terms relating to any Services except those set out in this Agreement.
  • Julia Ewert guarantees all services are supplied to you with due care and skill and fit for the purpose that the services have been advertised.
  • To the extent Julia Ewert is unable to exclude liability by law; total liability for loss or damage you suffer or incur from services by Julia Ewert is limited to re-supplying the Services to you,
  • or, at Julia Ewert’s option, refunding to you the amount you have paid for the Services to which your claim relates.

Dispute Resolution
You understand and agree:

  • You will contact Julia Ewert immediately with any concerns so that they may be resolved quickly and effectively through friendly consultation.
  • Any public discussion or comments about either party will be considered defamatory, harmful or otherwise damaging. They will be the subject of compensation in any mediation or litigation claim.

Governing Law
This Agreement is governed and construed by the laws of the State of Western Australia.
Each Party irrevocably and unconditionally submits to the exclusive jurisdiction of that State.

By proceeding with payment and engagement of Julia Ewert’s products and/or services, you confirm that you have read, understood and agreed to the terms and conditions contained in this Agreement.
